This privacy policy (“Privacy Policy”) explains how The Mindfulnest (“Mindfulnest,” “us,” “we,” or “our”), collects, uses, and discloses information about you when you use our mobile application, and when interacting with us.

 

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website homepage or sending you a notification).

1. Which data do we process?        

1.1 Information you provide to us

We collect information when you register for an account, request customer support, or otherwise communicate with us. The information you must provide includes your name, university email, and study area.

 

1.2 Other information about your use of the App

When you use our App, we collect the following information about you:

·       Usage Information: Whenever you use our App, we collect usage information, such as the sessions you use, what screens or features you access, and other similar types of usage information.

·       Log Information: We collect standard log files when you use our Services, which include the app version, access times and dates.

 

2. What purposes do we process your personal data for? 

We use the information we collect:

  • To provide you with the App, maintain and improve our App, including debugging to identify and repair errors, and developing new products and services;
  • To answer your questions or requests for information or handle your complaints.
  • To ensure that content provided by the Products is presented in the most effective manner for you and for your computer or other device.
  • To monitor and analyze trends, usage, and activities in connection with our App.
  • To comply with the law, such as by processing transactional records for tax filings and other compliance activities.

 

3. On what legal grounds do we process your personal data?

In accordance with GDPR, The Mindfulnest provides the following information regarding its Article 6 legal bases for personal data processing: article 6 paragraph 1 under b: the processing is necessary for the performance of a contract to which the data party is subject. The performance of the agreement between you and The Mindfulnest for the data processing relating to your use of the App.

 

When we process your personal data, we will only do so in the following situations:

·       When we have your consent to do so.

·       As necessary to comply with our legal obligations

·       When we have a legitimate interest in processing your personal data, including to communicate with you about updates and changes in our App, to help secure and improve our App (including to prevent fraud) and to analyze use of our App.

·       From our business interest in collecting data regarding your general usage activities for the purpose of improving our user experience.

 

4. Do we disclose your data to third parties?

We share information about you as follows and as otherwise described in this Privacy Policy or at the time of collection:

  • With your university we only share aggregated data, ensuring that they gain insights into usage patterns and their impact on student wellbeing.
  • With companies and contractors that perform services for us, including email service providers and possible other service providers.
  • In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company.

 

5. How long do we store your personal data?

We retain personal data for no longer than is necessary for the purposes for which it is processed, unless applicable law requires storage for a longer period of time. In the event that an account remains inactive for a period exceeding 12 months, both the account itself and its associated personal data will be deleted.

 

6. How do we protect your personal data?

The security of your personal data is important to us. We follow generally accepted standards to protect the personal data submitted to us, both during transmission and once it is received.

 

Except as described under the “Disclosure of Your Data” section below, we do not provide your personal data to any third party without your specific consent, as defined by applicable law.

 

The Mindfulnest maintains technical safeguards to help protect the security of your personal information against unauthorized access, destruction, loss, alteration, misuse or disclosure. Your personal information is accessible to only a limited number of personnel who need access to the information to perform their duties. Please note, however, that no method of transmission over the internet or method of electronic storage is 100% secure.

 

7. What are your rights?

Subject to certain limits and conditions provided under law, you have the following rights:

  • You have the right to access personal data we hold about you and to ask that your personal data be corrected, erased, or made available in a portable form.
  • You also have the right to object to certain processing (like receiving direct marketing), or request that we restrict processing in certain circumstances (like to retain but not further process pending resolution of a claim).

8. Is this Privacy Policy subject to change?

We may update this Privacy Policy to reflect changes to our data practices. If we make any material changes, we will notify you by email or by means of a notice in the App prior to the change becoming effective.
